    I wonder what percentage of these HBOS mass assignments to 1st Credit are made up of so-called 'Preference Accounts'...?

      Out of interest can you not still send a s.78 CCA Request even after you've received a SD because a SD is not a court summons it's a formal demand sent direct from a creditor not issued by a court

      I certainly wouldn't advocate anyone waiting for a SD before doing what Blue Star suggests because a SD is one step too close to BR for comfort and getting a set aside can cost lots of money if you don't want to DIY it But once a county court summons has been issued you can't send for a CCA so you have to go down the CPR route but as far as I'm aware with a SD it's different. I may be wrong

      I've been on the receiving end of a SD which was set-aside voluntarily (thanks to Paul) by the creditor who was forced to accept that there were outstanding "triable issues" (non compliance with my CCA) which should be dealt with by a county court first and not BR. This was something to do with the HC ruling in Hammond vs Pro Fit and it successfully scared them off

        Ok,

        You've previously sent a CCA to HBOS - regardless how they respond, forget that for now. That's history until much later on, if things get messy. In the meantime, you have had a letter from 1st Credit as detailed in this thread. At that point forget the norm and get a new CCA sent off to 1st Credit.

        If you sent a CCA Request to 1st credit and they have sent another threat (regardless of how they dealt with the last request) you then send the template in post 2.

        Basically, treat 1st Credit as a whole new creditor so instead of going with account sold template send a new CCA off. This will stop them in their tracks from trying to enforce something that cannot be enforced.....

        Make sense...?

          What a great thread Blue Star, it appears to us that HBOS is repeating History again....6 months ago they sold a batch of preference accounts and Credit Card Account to 1st Credit.

          My Hubby was one of 1st Credits victims then UNTIL the man himself stepped in..Sir Niddy he was our Knight in Shinning Armour and stopped 1st Credit instantly in their tracks....to that we are so grateful to Niddy.

          This thread shall be a god send to people like us, this site has been a life saver to us, with so many kindhearted people prepared to go the extra mile (especially Niddy) to help people so low in life that they don't know where to turn.

          Its got us wondering if we maybe hear from 1st Credit again as we do have another account with HBOS (Overdraft which Wescot has been trying to collect).....unless they realise that Niddy was on our case and give ours a wide bearth.

            Righty - I know that the DCA have just received our CCA request but today we had a another threat of CCJ off them...

            So I just have to wait now yes for them to respond to my CCA and ignore the threats?

              I got an SD threat from them today, but I know that they've received my CCA request, so for now I will ignore it. It may be that they crossed anyway.

                wish i had known niddy when 1st credit made out lives a living hell, i had a near breakdown .

                    Yes. I've been reading about this elsewhere and I don't think the advice is anywhere near as helpful as here, or as well coordinated.

                      And the very reason that the OCs flogged the troublesome accounts was due to them being UE in the first place after sending it around the houses to a ton of other unsuccessful DCA scumbags......LOL
